1 - Object The general conditions of sale described below detail the rights and obligations of the company Bettina Dupont and its client in the context of the sale of goods following: Photographic works of art, paintings and reproductions of paintings. Any service performed by the Bettina Dupont company therefore implies membership without reservation from the buyer to these general conditions of sale. 2 - Price The prices of the goods sold are those in effect on the day the order is taken. They are denominated in euros and calculated including tax (excluding shipping costs). The Bettina Dupont company grants itself the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated during registration of the order. 3 - Payment terms Payment for orders is made: • either by credit card on the site bettinadupont.fr • either by bank transfer by contacting the artist In the event of late payment, the seller may suspend all orders in progress. Any amount not paid by the due date appearing on the invoice automatically entails the application of penalties of an amount equal to one and a half times the legal interest. These penalties will be payable upon simple request from the seller. No discount is accepted for early payment. 4 - Termination clause In the event of non-payment, forty-eight hours after a formal notice remains unsuccessful, the sale will be automatically terminated by the seller who may request summary restitution of the products without prejudice to any other damages and interest. The amounts remaining due for other deliveries will become immediately due if the seller does not opt ​​for the cancellation of the corresponding orders. 5 - Reservation of title clause The Bettina Dupont company retains ownership of the goods sold until payment full price, principal and accessories. As such, if the buyer is subject to a recovery or judicial liquidation, the company Bettina Dupont reserves the right to claim, within the framework of the collective procedure, the goods sold and remained unpaid. 6 - Delivery Delivery is made by delivery to a carrier and is made to the address indicated on the invoice. Verification of the goods by the buyer must be carried out at the time of their collection. In the event of damage or missing items, complaints about apparent defects or non-conformity of the delivered product, the buyer will issue clear and precise reservations which he will notify within three days of the delivery date in writing to the seller or carrier. It will be up to the buyer to provide any justification as to the reality of the anomalies observed. The delivery time indicated when registering the order is only given as a indicative and is in no way guaranteed. Consequently, any reasonable delay in the delivery of the products cannot be give rise to the benefit of the buyer: • the award of damages; • cancellation of the order. 7 - Force majeure The liability of the company Bettina Dupont cannot be implemented if the non-performance or delay in the performance of any of its obligations described in the these general conditions of sale arise from a case of force majeure. As such, the strength major means any external, unpredictable and irresistible event within the meaning of the article 1148 of the Civil Code. 8 - Competent court Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law. Failing an amicable resolution, the dispute will be brought before the Commercial Court.
